How much did the defense of the accused in The Hague cost Kosovo?

Over 40.6 million euros have been paid from the Kosovo budget for legal protection and financial support of individuals indicted before the Specialist Chambers in The Hague.

The majority of this amount - around 39.8 million euros - was spent on legal protection, according to data that the Kosovo Ministry of Justice sent to Radio Free Europe.

Over 28.4 million euros were paid to Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi alone from 2021 to September 14, 2026.

The data is being made public on the eve of September 16, when the four former leaders of the Kosovo Liberation Army are expected to hear their verdict, after more than three years of trial.

The four, who have been held in custody in The Hague since November 2020, are accused of war crimes and crimes against humanity.

They have denied the charges and have pleaded not guilty.

Over 28 million euros for the four defendants

According to the Ministry of Justice, from the beginning of payments until September 14, 2026, over 40.6 million euros have been paid from the Kosovo budget in support of persons indicted before the Specialist Chambers.

Of this amount, around 39.8 million euros were spent on legal protection.

A total of around 28.47 million euros were paid to Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi alone in the period 2021-2026.

How much money was allocated from the budget?

Kosovo has undertaken by law to provide financial support to persons accused or potentially accused by the Specialist Chambers, including covering defense costs and other forms of support as determined by law.

According to the Ministry of Justice, for the years 2020 and 2021 together, 14.14 million euros were allocated for the implementation of this law.

In 2022, 6.85 million euros were allocated, in 2023 - 7 million, and in 2024 - 6.85 million euros.

For the years 2025 and 2026, 8.05 million euros have been allocated.

These allocations amount to approximately 50.95 million euros for the period 2020-2026.

The ministry did not provide figures for the years before 2020 in its response, although Radio Free Europe requested data for each year since 2015.

Kosovo budget data, collected by Radio Free Europe, show that allocations for this purpose, for the period 2018-2026, reach over 60 million euros.

The Ministry of Justice says that there are currently no outstanding obligations to lawyers or other beneficiaries under this program.

Payments are audited, but the report is not public

Defense spending in The Hague is subject to audit by the National Audit Office (NAO), but the results of this audit are not publicly available.

Drejtori ekzekutiv i Institutit të Kosovës për Drejtësi (IKD), Ehat Miftaraj, thotë se ky institut ka ngritur që nga viti 2020 shqetësime për mungesën e informatave rreth mënyrës se si shpenzohen paratë publike për mbrojtjen në Hagë.

“Jo rrallëherë kemi parë edhe politizim të partisë në pushtet lidhur me shpenzimet e mbrojtjes, duke publikuar shumat totale për të gjithë të pandehurit, duke ndërtuar jo rrallëherë dhe narrativin sikur shteti po shpenzon miliona euro për të njëjtit”, thotë ai për Radion Evropa e Lirë.

Sipas Miftarajt, publiku duhet të dijë jo vetëm shumën totale, por edhe sa është paguar për secilin të akuzuar dhe cilat kategori shërbimesh janë mbuluar - pa cenuar konfidencialitetin e mbrojtjes.

Edhe Anton Nrecaj, drejtor në Qendrën për Ndihmë Juridike dhe Zhvillimin Rajonal (CLARD), thotë se duhet bërë dallim i qartë mes buxhetit të ndarë dhe parave të shpenzuara realisht.

“Janë publikuar disa shuma individuale, por jo të gjitha të dhënat janë të plota. Publiku duhet të dijë shumën, periudhën, kategorinë dhe bazën e pagesës, pa cenuar konfidencialitetin e mbrojtjes”, thotë Nrecaj për Radion Evropa e Lirë.

Sipas tij, transparenca duhet të mundësojë edhe verifikimin nëse pagesat janë bërë në përputhje me ligjin, tarifat dhe kompleksitetin e rasteve.

Çfarë paguan shteti?

Baza për financimin nga shteti u krijua në vitin 2015, kur, krahas Ligjit për Dhomat e Specializuara, Kuvendi i Kosovës miratoi edhe Ligjin për mbrojtjen juridike dhe mbështetjen financiare të personave potencialisht të akuzuar në proceset gjyqësore pranë Dhomave të Specializuara.

Ligji u garanton personave që përfshihen në këtë kategori mbështetje financiare për mbulimin e shpenzimeve të mbrojtjes, si dhe forma të tjera të mbështetjes të përcaktuara me ligj dhe akte nënligjore.

Ministria e Drejtësisë thotë se shpenzimet për mbrojtjen realizohen në bazë të Udhëzimit Administrativ MD 08/2022 për mbrojtjen juridike të personave potencialisht të akuzuar, të ndryshuar dhe plotësuar në vitin 2024.

Shpenzimet për vizitat e familjarëve mbulohen në bazë të një udhëzimi tjetër administrativ, të miratuar në vitin 2020 dhe të ndryshuar në vitin 2022.

According to the rules in force, an accused person can be visited, with financial support, by a maximum of 12 close family members within a year and no more than three family members per visit.

The Specialist Chambers were established in 2015 under Kosovo law, but are headquartered in The Hague and are composed of international judges and prosecutors.

They address allegations of crimes committed during and after the 1998-1999 war, linked to former members of the Kosovo Liberation Army.

Compensation in case of acquittal

The law and an administrative instruction of the Ministry of Justice provide for compensation for persons accused before the Specialist Chambers who are found not guilty by a final decision.

The Instruction establishes that the right to compensation for the period of deprivation of liberty belongs to persons against whom an indictment has been filed and a judicial procedure has been conducted before the Specialized Chambers, if they are declared innocent by a final decision.

In addition to the period of deprivation of liberty, the instruction also regulates compensation for material damage or lost profit, as well as non-material or moral damage.

The Instruction does not set a fixed amount of compensation for each day spent in detention by an accused before the Specialist Chambers.

Miftaraj says that, according to the rules and practice used for compensation for deprivation of liberty, the amount varies depending on how the request is handled and the circumstances of the case.

"According to the internal regulations of the Kosovo Judicial Council, the administrative reference for one day of unlawful deprivation of liberty is up to 25 euros per day. While judicial practice, in cases where the parties have taken their case to court, has ranged from 30 to 60 euros per day, depending on the circumstances of the case," explains Miftaraj.

With the verdict of September 16, the trial against four former KLA leaders may enter a new phase.
