DW: Senior officials in the investigation, individual responsibility?

On September 22, the director of the State Intelligence Service, Vlora Hyseni, was in Baku, Azerbaijan, at an international conference with heads of intelligence services.

In Tirana, meanwhile, the Special Court imposed house arrest and suspension from duty on her, on suspicion of supporting the perpetrator of the crime and revealing investigative secrets. Amidst the uncertainties over the country's national security, President Bajram Begaj convened the National Security Council on Monday (28.09.2026). 

"Justice investigations should be conducted completely independently and respected by all. Individual cases should not turn into a crisis of trust in the state and security institutions," the statement distributed after the meeting said. But the case of the former head of SHISH does not stand alone.

Former President Ilir Meta has spent almost two years in detention. Former Prime Minister Sali Berisha is on trial. Tirana Mayor Erjon Veliaj has been in custody since early 2025. Two former deputy prime ministers in Rama's government, Arben Ahmetaj and Belinda Balluku, are also facing criminal charges. The investigations have also included senior leaders of the National Anti-Corruption Agency, ministers and other former senior officials.

"VIP" files

For years, high-level corruption went unpunished. Therefore, one of the main expectations of the justice reform, launched in 2016, was that high-ranking officials and politicians would no longer be beyond the reach of justice. "The expectation was that the new justice institutions would focus on high-level corruption and 'VIP' cases," Afrim Krasniqi, political scientist and executive director of the Institute of Political Studies, tells DW. "There were individuals who were above the law and impunity was pronounced."

But the results from the reform did not come immediately. The establishment and consolidation of new institutions took years, while investigating old cases was often more difficult.

Kush e parandalon korrupsionin?

Dalja para drejtësisë e zyrtarëve të lartë është vetëm njëra anë e funksionimit të institucioneve. Sepse kur një rast korrupsioni mbërrin në prokurori, shkelja e dyshuar tashmë ka ndodhur. Sipas Dorian Matlijës, pikërisht këtu rezultatet janë më pak bindëse.

"Po bëhemi më efektivë në ndëshkimin e korrupsionit pasi ai ka ndodhur, por jemi shumë më pak të aftë për ta parandaluar”- thotë ai.

Sipas tij parandalimi duhet të nisë shumë më herët, përmes kontrolleve administrative, auditimeve, rregullave për konfliktin e interesit dhe deklarimit të pasurisë. Por Matlija vlerëson se këto mekanizma shpesh nuk e kanë kryer funksionin e tyre.

Edhe Komisioni Evropian arrin në një përfundim të ngjashëm në raportin e vitit 2025 për Shqipërinë. Ai vlerëson se SPAK ka bërë "progres të prekshëm” në luftën kundër korrupsionit të nivelit të lartë. Por, në të njëjtën kohë, korrupsioni mbetet i përhapur dhe mekanizmat për parandalimin e tij kanë pasur efekt të kufizuar.

Përmasat e problemit shfaqen edhe në kontaktet e qytetarëve me administratën. Në një sondazh të SELDI-t të vitit 2023, 52 % e të anketuarve në Shqipëri thanë se ishin përballur me presion korruptiv nga zyrtarë publikë, ndërsa 40 % deklaruan se kishin paguar ryshfet.

Afrim Krasniqi e sheh problemin edhe në raportet e pushtetit. Partia Socialiste qeveris Shqipërinë që prej vitit 2013 dhe aktualisht ka shumicën absolute në Kuvend. Sipas tij, dominimi i zgjatur i një force politike ka dobësuar mekanizmat që duhet të kontrollojnë pushtetin ekzekutiv. "Kemi një sistem të deformuar” - thotë Krasniqi për DW. "Kreu i ekzekutivit kontrollon ekzekutivin, parlamentin dhe institucionet.”

Sipas tij, përqendrimi i pushtetit është shoqëruar edhe me rrjete informale ndikimi, përmes të cilave individë jashtë institucioneve shtetërore mund të ndikojnë në vendimmarrjen politike, legjislacion dhe përdorimin e pasurive publike.

Kryeministri Rama thekson se përgjegjësia penale është individuale sa herë që hetimet kanë përfshirë zyrtarë të lartë. Edhe për rastin Hyseni, qëndrimi i tij ishte i njëjtë.

"Kur një zyrtar i lartë i ka hapur vetes një llogari me drejtësinë, edhe kjo e ish-drejtueses së Shërbimit Informativ, është një çështje individuale mes saj dhe organeve të drejtësisë. Nuk kam asgjë tjetër për të shtuar rreth kësaj teme në vetvete” - tha Rama.

Prova e rezultateve

In May, the EU confirmed the fulfillment of interim benchmarks for the "Fundamentals" chapter, which includes the rule of law. The focus now shifts to implementation and sustainable results.

Corruption indicators also paint a mixed picture. Albania has improved in Transparency International's Corruption Perceptions Index.

International, from 33 points in 2012 to 39 in 2025, but still lags behind EU countries.

For lawyer Matlija, European integration has helped strengthen institutions like SPAK. "The EU no longer just demands the adoption of laws and reforms, but concrete and sustainable results," he says.

For Afrim Krasniqi, this is precisely where the proof of integration lies, not only in the formal progress in negotiations, but in the change it brings to the country. "The essence must be that Albania, Albanian society and Albanian institutions change and improve, so that we become worthy of integration," says Krasniqi.

According to him, this change should also be felt by citizens, through social security, welfare and independence, and not remain just an achievement on paper. /DW
