
The Kosovo Specialist Chambers in The Hague have found that the Specialist Prosecution has failed to prove the existence of a widespread attack against the civilian population, as one of the conditions for establishing crimes against humanity.
During the announcement of the verdict against the four former KLA leaders, the presiding judge, Charles L. Smith III, said that the evidence presented by the Office of the Specialized Prosecutor did not prove this element of the charge.
"Regarding the existence of a widespread attack against the civilian population as a condition for a crime against humanity, the Trial Chamber found that the SPO failed to establish that this widespread attack against the civilian population was committed," Smith stated.
