
The Constitutional Court of Kosovo has issued a decision on the constitution of the assembly and the formation of the government, after they were contested by the Democratic Party of Kosovo.
The Constitutional Court has found that the Assembly was constituted after the deadline, without specifying the legal consequences for the deputies who violated the deadline.
However, the constitution of the Assembly outside the 30-day period, according to the court, results in the expiration of the deadline for electing the president.
"The expiration of the thirty (30) day deadline for the constitution of the Assembly of the Republic of Kosovo results in the beginning of the constitutional deadlines for the election of the President of the Republic of Kosovo, when the position of President is vacant, and for the election of the Government of the Republic of Kosovo," the Constitutional Court's announcement states.
This term expires on October 6, 2026.
"The sixty (60) day period for the election of the President of the Republic of Kosovo began on August 8, 2026 and ends on October 6, 2026," the decision states.
The court obliges the deputies of the Assembly of Kosovo to elect the deputy speaker from among the second largest parliamentary group as soon as possible.
Regarding the formation of the Kosovo government, the Constitutional Court finds that the government was not elected in violation of the constitution.
"Decision [No. 11-V-007] of September 13, 2026 of the Assembly of the Republic of Kosovo on the election of the Government of the Republic of Kosovo is not in contradiction with Article 95 [Election of the Government] of the Constitution of the Republic of Kosovo," the Constitutional Court's decision states. /LAPSI.al
