The Kosovo Parliament approved by a majority of 99 votes a statement regarding the decision of the Kosovo Special Court based in The Hague, which two weeks ago convicted the four former leaders of the Kosovo Liberation Army, Hashim Thaçi, Jakup Krasniqi, Kadri Veseli and Rexhep Selimi, of war crimes. The Serbian MPs were not present.
The statement states that the Assembly expresses its deep concern over the first-instance decision against the KLA foursome and "considers the conclusion about the existence of a common criminal intent" mentioned in the trial as unacceptable.
Therefore, it is further stated, "convinced that respect for the rule of law also includes the right and responsibility to oppose, by legal and institutional means, such a judgment is considered unjust by the Assembly of Kosovo."
Circumstances of systematic repression
The declaration, which contains seven points, recalls that "the people's struggle for freedom and independence through the Kosovo Liberation Army was born in circumstances of systematic repression and genocidal crimes by Serbia, when the people of Kosovo were being denied their fundamental rights and the very opportunity to live freely in their country."
The statement further mentions the crucial importance of NATO's intervention in stopping violence against the people of Kosovo and in liberating the country.
"No verdict can undo the historical truth of the war in Kosovo. Serbia committed genocide and crimes against humanity," the statement further states.
State strategy for the protection of truth
Following the Hague ruling, the parliament, through a declaration, requests all state institutions of Kosovo to take all necessary actions to protect the truth and purity of the liberation war of the people of Kosovo, calling for "the drafting of a joint state strategy, within which legal, institutional and diplomatic actions would be coordinated for the protection and affirmation of the full historical truth about the just war for freedom and liberation of Kosovo."
The Assembly requests the Specialist Chambers to respect the mandate in accordance with the will of the Assembly of Kosovo, thus opposing "any attempt to subvert the historical truth of Kosovo, to question its liberation war or to equate the people who fought for freedom and survival with the regime that oppressed them."
Request for amending the law on the Special Court
Më 16 shtator, Gjykata Speciale ish-krerëve të UÇK-së u shqiptoi dënime për krime lufte. Hashim Thaçi dhe Jakup Krasniqi u dënuan me nga 25 vjet burgim. Me 18 vjet burgim u dënua Kadri Veseli dhe me 13 vjet burgim Rexhep Selimi.
Javën e shkuar Partia Demokratike e Kosovës, parti kjo që ngërthen në politikën e saj vlerat e luftës së UÇK-së, i propozoi qeverisë të nisë verfikimin e ndryshimeve te paraqitura në projektligjin për Dhomat e Specializuara apo, siç njihet në opinion, Gjykata Speciale.
Sipas projektligjit ndër të tjera kërkohet që juridiksioni i Gjykatës Speciale të kufizohet vetëm te veprat penale të përmendura në raportin e vitit 2011 të Asamblesë Parlamentare të Këshillit të Evropës, i cili trajtonte, ndër të tjera, pretendimet për trafikim organesh pas luftës në Kosovë. Projektligji parashikon që edhe periudha kohore që mbulon Gjykata Speciale, nga janari i vitit 1998 deri në dhjetor të vitit 2000, të ndryshohet në periudhën nga 1 korriku i vitit 1999 deri në dhjetorin e vitit 2000. Në projektligj pos neneve të shumta, parashihet edhe që dënimet e Gjykatës Speciale të ekzekutohen në Kosovë dhe personat e dënuar të mos përjashtohen nga e drejta e Presidentit të Kosovës për falje. Ligji akoma nuk ëstë miratuar, por i është paraqitur qeverisë.
Ndryshimi i ligjit për Gjykatës Speciale proces kompleks
Njohësit e çështjeve juridike, nga ana e tyre, thonë se nismat për plotësim dhe ndryshim të ligjit për Dhomat e Specializuara janë tejet komplekse. Ehat Miftaraj nga Instituti i Kosovës për Drejtësi tha për DW-në se deputetët e Kuvendit kanë të drejtë dhe kompetencë kushtetuese për të iniciuar plotësim dhe ndryshim të Ligjit për Dhomat e Specializuara, por "me kusht që plotësimi dhe ndryshimi i ligjit të mos cenojë detyrimet që ka marrë Kosova në bazë të amendamentit kushtetues të përcaktuar me nenin 162 të Kushtetutës. Po ashtu, çdo plotësim dhe ndryshim i ligjit nuk mund të jetë në kundërshtim me detyrimet ndërkombëtare që ka marrë përsipër Republika e Kosovës”.
Sipas Miftarajt çdo plotësim apo ndryshim i ligjit duhet të bëhet në konsultim dhe bashkëpunim me shtetet kryesore të Këshillit të Bashkimit Evropian apo SHBA-në, në mënyrë që këto ndryshime të kenë efekt dhe të jenë të zbatueshme në praktikë.
Protesta kundër vendimit të Gjykatës Speciale
Që nga shpallja e dënimit për ish-krerët e UÇK-së, në Prishtinë dhe qytete të tjera të Kosovës, çdo ditë vazhdojnë të mbahen protesta kundër vendimit të Gjykatës Speciale. Dhomat e Specializuara, apo siç njihet në opinion Gjykata Speciale, u themeluan nga Kuvendi i Kosovës në vitin 2015 dhe selinë e ka në Hagë.
Its staff is entirely international. The Special Court deals only with cases related to alleged crimes committed by members of the KLA during the 1998-1999 war. The Special Court, through a special article, became part of the Constitution of Kosovo, which was approved by two-thirds of the then members of parliament and also by two-thirds of the minority members of parliament, including representatives of the Kosovo Serbs in the Assembly.
According to two other articles of the Constitution, the mandate of the Special Court ends only when the Council of the European Union notifies Kosovo of the end of the mandate, thus making the Special Court a mechanism over which the Kosovo authorities, under existing law, have no competence. / DW
