The GJKKO decision to seize the villa in the “Green Coast” complex contains a number of communications and emails that the Prosecution has administered as part of the investigation. They include communications about the design, changes to the villa, the swimming pool and the works, but also other messages related to the tender procedure for the Tirana Outer Ring Road. Some of the communications are directly related to Belinda Balluku's email address and the requests that, according to the decision, she had made for changes to the project of villa 188 in Green Coast.
"We have ideas even if one day you decide to rent it out"
In an email dated September 14, 2020, sent by Alban Efthimi to the address belinda.balluku@gmail.com, in the subject line "PLANE REV 01", a series of proposals for the villa are described.
The message mentions possible changes in the organization of spaces, stairs, parking, swimming pool and terrace. Among other things, it says:
“We have ideas even if one day you decide to rent it out.”
The same communication also describes the possibility of placing a dining table by the pool, the use of the terrace, and changes to the rooms of the house.
Four days later, on September 18, 2020, another email was sent to the same email address. Attached, according to the decision, was a document titled “200918_VILAT BIJAKE 188_PALASË.pdf”, which included floor plans and surface plans for the two villas.
Project changes: “According to client requirements”
In another communication dated October 1, 2020, the design studio sent the floor plan of villa 188, stating that changes were reflected according to the client's requests.
The follow-up email mentions that the client's requirements have been reflected in the project and that, once a new agreement is reached, work on the project elements will continue.
In a communication dated October 12, 2020, the studio writes that, regarding the volumes enclosed with glass, it cannot take them on without a technical solution due to the problems that the climatic conditions of the area may create.
The villa changed during the works
Communications administered in the file continue throughout 2021 and 2022, where other changes to the project are discussed.
One of them mentions the request to change the walls, expand the spaces and reflect the client's requests in the floor plan. Another email directly refers to the client's approval for changing the corridor of villa 188, writing that Olsi Efthimi had requested that the corridor be narrowed to create more space for the rooms.
The file also includes communications about the pool, where the design studio sends materials for the "jacuzzi and pool, VILLA 188", as well as materials for the demolition of walls and other changes to the villa.
25 thousand euros for the swimming pool
Another element identified by the investigation is related to the financing of the works.
According to the data included in the decision, in the financial system of the company "SuperPool Kimya", the client column resulted in "PISHINA ARBER ABAZI (DHERM + BELINDA)".
According to the documentation described by the court, there were two invoices for the pool works, one for 15 thousand euros with the description "Laying of pipe lines, phase 1 pool" and the other for 10 thousand euros with the description "Pre-preg". The total was 25 thousand euros.
Messages for the Ring Road tender
In addition to communications related to the villa, the decision also contains communications managed from Evis Berberi's phone and communications between him and Miranda Shkurti.
On August 11, 2021, on the day of the opening of bids for the tender procedure, Miranda Shkurti sends Berber a message in which she writes:
"Are the September 15, 2021 offers open?"
Later, in other communications, the bids and participating economic operators are discussed. In one of them, Miranda Shkurti sends Berber a photograph showing the names of the operators and the values of the bids.
One of the other messages cited in the decision is that of October 1, 2021, when Balluku writes to Evis Berberi:
"Get ready for the rings on Monday morning."
Following this communication, according to the decision, Balluku also wrote to Berber for a meeting and for documentation related to the procedure.
During this same period, on October 5, 2021, Berberi sends Balluku a message telling him that someone from the show "Stop" had come and requested information about the procurement procedure for Lot 1. In response, according to the decision, Balluku writes:
"If you break the raft, do the work and enforce the law. When the deadline for the response is set for you."
The decision states that on October 6, 2021, the procedure for the facility "Construction of the Tirana Outer Ring Road, Lot 4" was completed in the electronic procurement system.
What importance does the GJKKO give to these communications?
The communications are part of the materials that the court has considered to assess SPAK's request for the seizure of the villa. In the decision, the Prosecution claims that the villa and the works carried out in it are related to suspected irregular benefits from the Outer Ring Road tender procedure, while the court has assessed that at this stage there is data that justifies the preventive seizure measure.
